HAM d.o.o. develops, patents, manufactures and markets SpinaliS office chairs with a flexible seat, which enable active sitting and promote correct posture and back muscle strengthening.
EN 1335-1, EN 1335-2, EN 1335-3 standards are taken into account in the design and construction. The chair belongs to Group B of EN 1335-2.
SpinaliS has a patent (PATENT-SI-20508, PCT/SI00/00033TUV-A-MHF/SF-1/02-03202) and protected designs. Copying or misuse of the patent is prohibited.
3. Procurement and conclusion of the contract
Orders can be placed:

- in person at the salon
- in writing by post
- at trade fairs and demonstrations
By placing an order, the Buyer acknowledges that he/she has read and agrees to these Terms and Conditions.

4. Prices and payments
Prices are retail prices and include VAT.
The price at the time the order is placed applies.
Discounts are not cumulative (the highest single benefit applies).
Payment methods:
- by invoice
- by credit card
- via Pay Pal
Vouchers or gift vouchers cannot be exchanged for cash.
5. Delivery and collection
Delivery time: 10 to 14 working days.
The time limit starts on the day the payment is received.
Delivery within Slovenia is included in the price.
If the parcel is lost and not found by the delivery service within 10 days, the Seller will deliver a new chair to the Buyer.
For non-standard designs, a replacement chair may be provided until delivery.
The chairs are partially assembled and packed in a cardboard box with assembly instructions.
6. Refunds and withdrawal
6.1 B2C / B2B distinction
The conditions apply differently depending on the status of the customer.
6.2 CONSUMERS (B2C)
Right of withdrawal (14 days – ZVPot-1)
The consumer may withdraw from the contract within 14 days of receipt of the goods without giving a reason.
The goods must be returned within 14 days of the declaration of withdrawal.
Use is only permitted to ascertain the nature, characteristics and performance.
The Seller shall refund the purchase price within 14 days of receipt of the notice of withdrawal, but may withhold the refund until receipt of the goods.
Return costs outside Slovenia are the responsibility of the buyer.
6.3 30-DAY GOODWILL GUARANTEE (valid in Slovenia only)
The customer can return up to two (2) chairs within 30 days if he/she is not satisfied.
Conditions:
- undamaged chair
- original packaging
- warranty card
Dirty chair: up to 10% cleaning charge.
Damaged chair: pro-rata reduction in refund.
Applies to chairs in the regular range.
6.4 LEGAL PERSONS (B2B)
The statutory right of withdrawal of 14 days does not apply.
Refunds are only possible with prior written agreement.
Error notification (B2B)
- report obvious defects within 5 days of receipt
- report hidden errors within 5 days of discovery
- within 6 months of takeover
Otherwise, he loses the right.
7. Warranty and non-compliance
Manufacturer’s warranty: 3 years.
Repair within 45 days, otherwise replacement.
The guarantee does not apply to:
- mechanical damage
- incorrect use
- interference by unauthorised persons
- normal wear and tear on textiles
Spare parts are guaranteed for a minimum of 7 years.
The chairs are handmade and/or made from natural materials, so minor cosmetic imperfections are not considered a defect.
The manufacturer advises preventive servicing after seven (7) years of use.
8. Safety warnings
- Maximum permissible weight: 110 kg
- Don’t get on the seat
- Don’t sway on uneven ground
- Hold on to both backrests when sitting down
- Do not reach into the spring area
- The user must not repair the chair himself
- Persons with balance problems should take extra care
- Light fabrics can be stained by dark clothing
9. Maintenance
Clean with a damp cloth and mild detergent.
A drop of oil can eliminate the squeaking of the mechanism.
10. Intellectual property
HAM d.o.o. remains the exclusive owner of all intellectual property rights, patents, designs, know-how and domains.
The purchase of a product does not transfer any intellectual property rights to the buyer.
11. Limitation of liability
The liability of HAM Ltd. is limited to the repair or replacement of the product.

- loss of goodwill
- indirect or consequential damage
Except where prohibited by mandatory law.
12. Force Majeure
HAM d.o.o. is not liable for delays due to force majeure.
If it lasts more than three (3) months, either party may withdraw from the contract.
13. Protection of personal data
Data is processed in accordance with the GDPR and applicable law.

14. Dispute resolution
Disputes shall be settled amicably between the parties.
