Business<\/h2>\n<p>HAM d.o.o. develops, patents, manufactures and markets SpinaliS office chairs with a flexible seat, which enable active sitting and promote correct posture and back muscle strengthening.<\/p>\n<p>EN 1335-1, EN 1335-2, EN 1335-3 standards are taken into account in the design and construction. The chair belongs to Group B of EN 1335-2. <\/p>\n<p>SpinaliS has a patent (PATENT-SI-20508, PCT\/SI00\/00033TUV-A-MHF\/SF-1\/02-03202) and protected designs. Copying or misuse of the patent is prohibited. <\/p>\n<h2>3. Procurement and conclusion of the contract<\/h2>\n<p>Orders can be placed:<\/p>\n<ul>\n<li>via the online shop<\/li>\n<li>by e-mail<\/li>\n<li>by phone<\/li>\n<li>in person at the salon<\/li>\n<li>in writing by post<\/li>\n<li>at trade fairs and demonstrations<\/li>\n<\/ul>\n<p>By placing an order, the Buyer acknowledges that he\/she has read and agrees to these Terms and Conditions.<\/p>\n<h3>Mandatory information when ordering<\/h3>\n<p><strong>Natural persons (B2C):<\/strong><\/p>\n<ul>\n<li>name and surname<\/li>\n<li>address of residence<\/li>\n<li>contact (phone or email)<\/li>\n<li>delivery address<\/li>\n<li>method of payment<\/li>\n<\/ul>\n<p><strong>Legal entities (B2B):<\/strong><\/p>\n<ul>\n<li>company name<\/li>\n<li>Headquarters<\/li>\n<li>VAT ID<\/li>\n<li>contact person<\/li>\n<li>delivery address<\/li>\n<li>method of payment<\/li>\n<\/ul>\n<h2>4. Prices and payments<\/h2>\n<p>Prices are retail prices and include VAT.<br \/>\nThe price at the time the order is placed applies.<br \/>\nDiscounts are not cumulative (the highest single benefit applies).<\/p>\n<p>Payment methods:<\/p>\n<ul>\n<li>by invoice<\/li>\n<li>by credit card<\/li>\n<li>via Pay Pal<\/li>\n<\/ul>\n<p>Vouchers or gift vouchers cannot be exchanged for cash.<\/p>\n<h2>5. Delivery and collection<\/h2>\n<p>Delivery time: 10 to 14 working days.<br \/>\nThe time limit starts on the day the payment is received.<\/p>\n<p>Delivery within Slovenia is included in the price.<\/p>\n<p>If the parcel is lost and not found by the delivery service within 10 days, the Seller will deliver a new chair to the Buyer.<br \/>\nFor non-standard designs, a replacement chair may be provided until delivery.<\/p>\n<p>The chairs are partially assembled and packed in a cardboard box with assembly instructions.<\/p>\n<h2>6. Refunds and withdrawal<\/h2>\n<h3>6.1 B2C \/ B2B distinction<\/h3>\n<p>The conditions apply differently depending on the status of the customer.<\/p>\n<h3>6.2 CONSUMERS (B2C)<\/h3>\n<h4>Right of withdrawal (14 days &#8211; ZVPot-1)<\/h4>\n<p>The consumer may withdraw from the contract within 14 days of receipt of the goods without giving a reason.<\/p>\n<p>The goods must be returned within 14 days of the declaration of withdrawal.<br \/>\nUse is only permitted to ascertain the nature, characteristics and performance.<\/p>\n<p>The Seller shall refund the purchase price within 14 days of receipt of the notice of withdrawal, but may withhold the refund until receipt of the goods.<\/p>\n<p>Return costs outside Slovenia are the responsibility of the buyer.<\/p>\n<h3>6.3 30-DAY GOODWILL GUARANTEE (valid in Slovenia only)<\/h3>\n<p>The customer can return up to two (2) chairs within 30 days if he\/she is not satisfied.<\/p>\n<p>Conditions:<\/p>\n<ul>\n<li>undamaged chair<\/li>\n<li>original packaging<\/li>\n<li>warranty card<\/li>\n<\/ul>\n<p>Dirty chair: up to 10% cleaning charge.<br \/>\nDamaged chair: pro-rata reduction in refund.<br \/>\nApplies to chairs in the regular range.<\/p>\n<h3>6.4 LEGAL PERSONS (B2B)<\/h3>\n<p>The statutory right of withdrawal of 14 days does not apply.<br \/>\nRefunds are only possible with prior written agreement.<\/p>\n<h4>Error notification (B2B)<\/h4>\n<ul>\n<li>report obvious defects within 5 days of receipt<\/li>\n<li>report hidden errors within 5 days of discovery<\/li>\n<li>within 6 months of takeover<\/li>\n<\/ul>\n<p>Otherwise, he loses the right.<\/p>\n<h2>7. Warranty and non-compliance<\/h2>\n<p>Manufacturer&#8217;s warranty: 3 years.<br \/>\nRepair within 45 days, otherwise replacement.<\/p>\n<p>The guarantee does not apply to:<\/p>\n<ul>\n<li>mechanical damage<\/li>\n<li>incorrect use<\/li>\n<li>interference by unauthorised persons<\/li>\n<li>normal wear and tear on textiles<\/li>\n<\/ul>\n<p>Spare parts are guaranteed for a minimum of 7 years.<br \/>\nThe chairs are handmade and\/or made from natural materials, so minor cosmetic imperfections are not considered a defect.<br \/>\nThe manufacturer advises preventive servicing after seven (7) years of use.<\/p>\n<h2>8. Safety warnings<\/h2>\n<ul>\n<li>Maximum permissible weight: 110 kg<\/li>\n<li>Don&#8217;t get on the seat<\/li>\n<li>Don&#8217;t sway on uneven ground<\/li>\n<li>Hold on to both backrests when sitting down<\/li>\n<li>Do not reach into the spring area<\/li>\n<li>The user must not repair the chair himself<\/li>\n<li>Persons with balance problems should take extra care<\/li>\n<li>Light fabrics can be stained by dark clothing<\/li>\n<\/ul>\n<h2>9. Maintenance<\/h2>\n<p>Clean with a damp cloth and mild detergent.<br \/>\nA drop of oil can eliminate the squeaking of the mechanism.<\/p>\n<h2>10. Intellectual property<\/h2>\n<p>HAM d.o.o. remains the exclusive owner of all intellectual property rights, patents, designs, know-how and domains.<br \/>\nThe purchase of a product does not transfer any intellectual property rights to the buyer.<\/p>\n<h2>11. Limitation of liability<\/h2>\n<p>The liability of HAM Ltd. is limited to the repair or replacement of the product.<\/p>\n<ul>\n<li>loss of profit<\/li>\n<li>loss of goodwill<\/li>\n<li>indirect or consequential damage<\/li>\n<\/ul>\n<p>Except where prohibited by mandatory law.<\/p>\n<h2>12. Force Majeure<\/h2>\n<p>HAM d.o.o. is not liable for delays due to force majeure.<br \/>\nIf it lasts more than three (3) months, either party may withdraw from the contract.<\/p>\n<h2>13. Protection of personal data<\/h2>\n<p>Data is processed in accordance with the GDPR and applicable law.<\/p>\n<ul>\n<li>the performance of the contract<\/li>\n<li>legal obligations<\/li>\n<li>information by consent<\/li>\n<\/ul>\n<p>Data is not sold to third parties without a legal basis.<\/p>\n<h2>14.
